Os recordamos que en el caso de huelga y paros parciales:<\/p>\n

1. \u00a0 \u00a0 Ni el trabajador tiene que decir si va a hacer o no la huelga, ni la empresa puede preguntarlo<\/p>\n

2. \u00a0 \u00a0 La huelga no puede ser motivo de despido ni de ning\u00fan otro tipo de sanciones. La falta de ese d\u00eda tampoco puede computarse para un despido por absentismo.<\/p>\n

3. \u00a0 \u00a0 La ley indica que la huelga es motivo de \u00absuspensi\u00f3n\u00bb de las relaciones laborales. Esto quiere decir que el huelguista no realiza su trabajo y el empresario le descuenta ese d\u00eda de salario. Adem\u00e1s, empresa y trabajador dejan de cotizar a la Seguridad Social por esa jornada. Este descuento se har\u00e1 sobre las horas no trabajadas; tanto sobre el salario base como las horas complementarias (incluyendo la parte proporcional de la retribuci\u00f3n del descanso semanal y las pagas extras, as\u00ed como la participaci\u00f3n en beneficios). No afectar\u00e1, sin embargo, a las retribuciones en especie. Las vacaciones tampoco se ver\u00e1n afectadas ni en su duraci\u00f3n ni en su retribuci\u00f3n.<\/p>\n

4. \u00a0 \u00a0 La ley proh\u00edbe expresamente el relevo de los huelguistas por otros no vinculados a la empresa o la contrataci\u00f3n de sustitutos por ETT<\/p>\n

5. \u00a0 \u00a0 De existir servicios m\u00ednimos, el empresario deber\u00e1 comunicar previamente a los trabajadores escogidos que forman parte de estos servicios.<\/p>\n
